Terms and Conditions

BACKGROUND

​

Torung Market Perth Pty Ltd (ACN 647 225 452) 

​

  • A pop- up Thai style theme night market.

  • Operating 6.00 pm – 11.30 pm last Saturday of the calendar month throughout the year (12 markets /year). Our first grand opening is on 27th March 2021 held at Perth City Farm, East Perth WA 6004. More markets dates to be announced.

  • Locations are various around Perth CBD and South West Regions.

TERMS AND CONDITIONS

​

1. Booking​ 

​

TMP may offer a Vendor a space at a TMP event or events. TMP is not required to offer any Vendor any space at any TMP event.

 

  • If TMP offers a vendor a space, the Vendor may accept that offer by paying a non-refundable deposit of 20% (Deposit) of the Hire Rate for the Booking within 7 days of the offer being made by TMP. After the expiry of 7 days the offer lapses and the Booking is not guaranteed.

 

2. Fees

​

The following hire rates for Bookings (Hire Rates) apply:

  • Vendors may apply to book a space at a TMP event, or events (Booking), by completing the booking form and emailing it to info@torungmarketperth.com.au.

  • One-off event (contact us)

  • Yearly per year. Monthly payment (contact us)

 

Other items will be charged at the following:

  • Licensing help. Contact us for the quote.

  • Items calculated under clause 2 are called Fees and are exclusive of GST.

 

3. Payments

Vendors are required to place a 20% non-refundable deposit to secure the booking. The Fees due, calculated in accordance with clause 2 are then reduced by the Deposit. Payment of the remaining amount is due 2 weeks prior to market date.

 

4. Cancellations

  1. If a Vendor cancels their Booking, their Deposit will be forfeit unless the cancellation is advised to TMP 30 days prior to the market date.

  2. If TMP cancels a market date, Vendors will be offered a choice between full deposit refundable or held the deposit for the next event.

5. Vendor Obligations

  1. Licensing and compliance:

  2. Hold current food business license, food business notification (mobile food business) and food handling certificates;

  3. Maintain food-safe practice at all times;

  4. Having relevant liquor license and permits if selling alcohol;

  5. Comply with applicable COVID safe practices, as amended from time to time, including:

  • Maintaining a strict limit of a minimum of two square meters (2sqm) per person in the Food stall.

  • Maintaining hygiene and frequent cleaning, especially when handling cash

  • Self – complete a COVID Safety Plan prior to the booking

  • Displaying a COVID-19 Safety Plan Certificate (if have one)

  • Maintaining hygiene and frequent cleaning

  • Disinfecting shared equipment between use

  • Encouraging the use of cashless payment systems

  • Hold public liability insurance of $20 million and, if applicable, workers’ compensation insurance. Provide evidence of insurance on request.

​   6. Electrical

Vendor cables, power cords extension must be tagged and up to date before commencing the work by the TMP’s nominated qualified electrician.

   7. Safety

Vendor must strictly follow the safety policy and procedures, as well as any safety instructions given to it by TMP.

   8. Bump in / bump out

  • Vendors must ensure they provide adequate time for setting up. Vendors must be completely set up and ready to trade before the commencement of the market. Failure to meet this timeframe may result in cancellation of future Bookings or TMP not accepting any future booking applications.

  • Vendors must have commenced bump in at least 1 hour prior to commencement of the market.

  • Bump in will be available from 2pm unless otherwise advised. Tables and chairs are provided for each food stalls equally. Vendors are required to bring your own centrepiece/ condiments trays (if selling noodle bar) and decorate the stall as much as the Vendor wishes (Thai style theme only).

  • No orders are to be taken after 11.30pm.

  • Bump out must be completed by midnight.

  • Vendors indemnify TMP against any losses incurred in relation to their failure to bump in and bump out as required.​

 

6. Sustainability

Torung Market is promoting an environment friendly market. We are strongly encouraging our food stall venders serving their customers with the natural substitute plates and cutlery such as:

  1. Organic Bio disposable products – plants-based plates, bowls, and wooden cutlery.

  2. Banana leaves

  3. Pinto – Thai Style food containers (ปิ่นโต) - available at the event for hiring with no cost and rewashed facility provided (Perth City Farm venue only)

***Please note, strictly no plastic utensils and plates used in the Farm**

 

7. Waste management

Bins will be provided by TMP. Vendors must bring their own rubbish bags and ensure all rubbish is discarded in the correct bins. Failure to do so may result in extra charge for rubbish disposal being levied by TMP.

 

8. Presentation

To promote TMP for unique, authentic Thai Styles street food, food safe practice and hygiene, Vendors must ensure that all of their staff wear TMP aprons, wear food gloves if handling food, tie hair back if it is long, if possible wear their own Thai style hat and present themselves well. Please remember to smile, smile, smile.

9. TMP Actions

  • Site plan

TMP will provide a site plan after the Deposit is paid.

  • Safety

TMP will provide the safety policy and procedures pack after Deposit is paid.

 

7. General

  • Variation

These terms may be amended by TMP giving notice to Vendor.

 

  • No waiver

No party may rely on the words or conduct of any other party as being a waiver of any right, power or remedy arising under or in connection with this agreement unless the other party or parties expressly grant a waiver of the right, power or remedy.

 

  • Assignment, novation and other dealings

Any rights of a party that arise out of or under this agreement are not assignable by the party without the prior written consent of the other parties.

 

  • Time of the essence

Time is of the essence in this agreement in respect of any date or time period and any obligation to pay money.

  1. Relationship of the parties

    1. Nothing in this agreement gives a party authority to bind any other party in any way.

    2. Nothing in this agreement imposes any fiduciary duties on a party in relation to any other party.

  2. Entire agreement

 

This agreement states all the express terms agreed by the parties about its subject matter. It supersedes all prior agreements, understandings, negotiations and discussions in respect of its subject matter.

 

  • No reliance

No party has relied on any statement, representation, assurance or warranty made or given by any other party, except as expressly set out in this agreement.

 

 

  • Set-off

  1. (7.8(a)TMP is authorised to deduct any amount due and payable by Vendor from amounts otherwise due and payable to Vendor under or in connection with this agreement.

  2. Any exercise by TMP of its rights under clause 7.8(a) does not limit or affect any other rights or remedies available to it under this agreement or otherwise.

 

  • Governing law and jurisdiction

  1. This agreement is governed by the law in force in Western Australia.

  2. Each party irrevocably submits to the exclusive jurisdiction of courts exercising jurisdiction in Western Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement.
